Partner Visa 820/801

The Subclass 820/801 Partner Visa is a two-step process for gaining permanent residency in Australia and is to be lodged while you (the applicant) are in Australia. There is only one application for subclass 820/801, with the visas being issued in two stages. To be eligible for this visa, you must be the spouse (married) or de facto partner of an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

    The first stage is the temporary Partner Visa (subclass 820 visa), which allows you to live in Australia until your Permanent Visa decision is determined. To apply for a subclass 820 visa under this category, you must be in Australia.

    The Temporary Partner Visa (subclass 820 visa) will allow you to work, study and enrol in Medicare, but you will not receive any government funding for your studies. You may also mention any dependent children in your application.

    The second half of your application will be processed two years after your Temporary Partner Visa (subclass 820 visa) has been approved. If you are successful, you will be issued a permanent Partner Visa (subclass 801 Visa).

Provisional Partner Visa 309 & Partner (Migrant) Visa 100

Unlike the subclass 820/801 partner visa, you (the applicant) must be outside of Australia to apply for the subclass 309 Visa. The provisional partner Visa allows a de facto partner or spouse of an Australian citizen, permanent resident of Australia or eligible New Zealand citizen to live in Australia temporarily. This visa is the initial step towards gaining a permanent Partner Visa100.

    If you are a de facto partner, you must be able to show that the partnership has been in existence for at least a year. Time spent dating is omitted since the relationship must be genuine de facto. You may enter Australia once you have obtained your provisional visa, but not until it is granted.

Prospective Marriage Visa 300

The Prospective Marriage Visa (subclass 300) allows you (the applicant) to come to Australia to marry your future spouse before applying for a Partner Visa. It is commonly referred to as the fiancé visa as it is only applicable to individuals who intend to marry their spouse within 9 months of arriving in Australia. It is a requirement of this visa that you apply for it while outside of Australia and enter only once it has been granted.

    There is no requirement for the wedding to take place in Australia. People usually apply for this visa when they are unable to meet the conditions for the partner visa due to the fact that they have not been in a de facto relationship. You must, however, be able to demonstrate that you have met your future spouse in person as an adult and know them personally.

    For planned marriage scenarios, it is critical that you have met them as an adult, as many persons subject to arranged marriages may have only met the person as a child, which is insufficient for immigration purposes.
