Provisional Partner Visa 309 & Partner (Migrant) Visa 100
Unlike the subclass 820/801 partner visa, you (the applicant) must be outside of Australia to apply for the subclass 309 Visa. The provisional partner Visa allows a de facto partner or spouse of an Australian citizen, permanent resident of Australia or eligible New Zealand citizen to live in Australia temporarily. This visa is the initial step towards gaining a permanent Partner Visa100.
If you are a de facto partner, you must be able to show that the partnership has been in existence for at least a year. Time spent dating is omitted since the relationship must be genuine de facto. You may enter Australia once you have obtained your provisional visa, but not until it is granted.
Once you have held your subclass Visa 309 for at least two years you can apply for the subclass Visa 100. Once approved, the subclass Visa 100 allows the de facto partner or spouse of an Australian citizen, permanent resident of Australia or eligible New Zealand citizen to live permanently in Australia.
With the subclass Visa 100, you can live, work and study in Australia indefinitely, sponsor eligible family members to come to Australia and apply for Australian citizenship (if eligible).
